Terms of Service

These Terms of Service (“Terms”) govern your use of the image-generation application that creates images from personal photos (the “App”). By using the App, you agree to these Terms. If you do not agree, do not use the App.

Definitions

  • “Company,” “we,” “us,” or “our” means Mediaweb (VAT: PT501234567), with registered office at Rua Anzebino da Cruz Saraiva, Ed. Beira Rio, Piso 1 Esc. 28, 2415-371 Leiria, Portugal. Support: info@mediaweb.global.
  • “User,” “you,” or “your” means the person using the App.
  • “User Content” means photos, text prompts, and any materials you upload or provide.
  • “Generated Images” means outputs created by the App from your inputs.

1. Eligibility

You must be 16 years of age or older to use the App. Where local law permits a lower age (13–15), you must have verifiable parental consent. We may request proof of age when required. If you upload photos of someone else, you confirm that you have obtained all necessary permissions and explicit consent to process their image.

2. Account and Access

You may use the App anonymously or with a registered account. You are responsible for the security of your credentials and for all activity that occurs under your account. We reserve the right to refuse, suspend, or terminate accounts to protect our users or comply with the law.

3. Acceptable Use

You may not use the App to create, upload, or share content that is:

  • Illegal, defamatory, hateful, discriminatory, violent, sexually explicit, or exploits minors.
  • A harmful “deepfake,” including impersonation or deception likely to mislead the public.
  • Infringing on the intellectual property, privacy, or publicity rights of others.
  • A security risk or a form of service abuse (e.g., circumventing limits, reverse-engineering, spamming).

We may remove content or restrict access if these Terms are violated.

4. AI Processing & No Professional Advice

The App uses AI services (e.g., Google Cloud, Firebase, Vertex AI, or similar providers) to transform photos and generate images. Results may vary and can contain visual artifacts. Always review outputs before sharing. The App provides creative results and does not offer legal, medical, or professional advice.

5. Intellectual Property

Your User Content remains yours. You grant us a worldwide, non-exclusive, revocable, limited, royalty-free license to host, process, transform, display, and transmit your User Content solely to provide and improve the App. Subject to third-party rights, we assign to you the rights we hold in the Generated Images for personal and commercial use. You are responsible for ensuring your use of the output does not infringe on third-party rights.

6. Training of Models

We do not use your photos or Generated Images to train AI models without your separate, explicit opt-in consent.

7. Limitation of Liability

To the fullest extent permitted by law, our total liability for claims arising from the App will not exceed the greater of (a) the amounts you paid us in the 12 months before the claim or (b) EUR 50 if you made no payments. We are not liable for indirect, incidental, or consequential damages.

8. Governing Law and Venue

These Terms are governed by the laws of Portugal. Any disputes will be resolved in the competent courts of Lisbon, unless consumer law grants you a different mandatory forum.

9. Changes to These Terms

We may update these Terms for legal or operational reasons. We will notify you of material changes with reasonable advance notice. Continued use of the App after the effective date constitutes your acceptance of the new Terms.
